Ore. gillnet fishers still in limbo

The Oregon Court of Appeals in Salem heard oral arguments Monday on a petition requesting a stay of enforcement for rules affecting the commercial gillnet fishery on the Columbia River.
 
A decision on enforcing a stay could be determined in the coming weeks by the court, which would be in place during a judicial review of the new Oregon Department of Fish and Wildlife policy.
 
Steve Fick, owner of Fishhawk Fisheries and a petioner in the case, expressed the importance of the stay Monday and remained hopeful in the outcome for commercial gillnet interests.
 
The motion is the second made by Fick, Jim Wells and Fishhawk Fisheries. Filed in July, the motion states, “Because petitioners and the public will be irreparably harmed in the interim, and because petitioners are likely to prevail on the merits, the court should grant a stay of enforcement of the ODFW rules pending disposition of this judicial review.
