In another legal maneuver to keep the Drakes Bay Oyster Co. open, businesses that support the operation filed an appeal Monday of a ruling that went against them earlier this month.

 

On Sept. 9 U.S. District Court Judge Yvonne Gonzales Rogers rejected their injunction request to keep Drakes Bay open. But the lead attorney for the plaintiffs asserts the decision was wrong and they now are taking the case to the 9th U.S. Circuit Court of Appeals.

 

“People and businesses would be impacted if Drakes Bay closed,” said attorney Stuart Gross. “The people of West Marin and beyond do not want to see this sustainable food source go.”
